THIS LIMITATION OF LIABILITY SECTION APPLIES WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER BASIS. NATIONAL IQ TEST DOES NOT WARRANT THAT (A) THE SITE OR SERVICES WILL FUNCTION OR BE UNINTERRUPTED, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY ERRORS OR DEFECTS WILL BE CORRECTED, (C) THE SITE OR SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; (D) THAT YOU WILL FIND SUITABLE EMPLOYMENT, OR (E) THE RESULTS OF USING THE SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS. NATIONAL IQ TESTDISCLAIMS ALL IMPLIED LIABILITY FOR DAMAGES ARISING OUT OF THE FURNISHING OF THE PLATFORM PURSUANT TO THIS AGREEMENT.

12. No guarantee

Nationaliqtest.org takes it upon itself to provide the highest quality of services ordered by the users. However, Nationaliqtest.org can only be held accountable for an obligation of means as the provisions of its services are conditional and depend on the intervention of third parties.

Nationaliqtest.org does not guarantee any test results as the results vary from user to user. They depend on the intellectual skills of the individuals and cannot be the same for everyone.

Users must acknowledge that they are responsible for the consequences solely if they were to present the result to any third party. Nationaliqtest.org is not responsible for the risks and the dangers involved.

The arbitrator is bound by the terms of this Agreement. All issues in the dispute are for the arbitrator to resolve, except that issues relating to the enforceability of the arbitration provision are for a Court of Competent Jurisdiction to resolve. The arbitration may be conducted in person in the city and state where the user resides, or by telephone, email, online, or other technology where appropriate. The arbitrator shall apply Delaware law. The arbitrator will issue a decision in writing but need only provide a statement of reasons if requested by a party. The language in this Agreement shall be interpreted in accordance with its fair meaning and not strictly for or against either party.

Class-Action Waiver

You and test-iq.co agree that any arbitration or other legal action shall be limited to the two of us as parties, and any joinder of other parties is not allowed. You acknowledge and agree that this Agreement specifically prohibits you from commencing arbitration proceedings as a representative of others. This means that you cannot participate in any sort of representative proceeding against test-iq.co or Novomedia EOOD, including as a plaintiff or class member in any purported class action.

Governing Law and Location

This Agreement shall be governed by and construed in accordance with the genera laws of Sofia, Bulgaria and the specific applicable laws, if any, of Bulgarian Laws, without regard to its conflict of law principles.

Subject to and without waiving the arbitration agreement, the proper venue for any judicial action arising out of, relating to, or in connection with this Agreement will be the state and federal courts located in Sofia, Bulgaria (a “Court of Competent Jurisdiction”). You and test-iq.co stipulate to, and agree to waive any objection to, the personal jurisdiction and venue of such courts and submit to extraterritorial service of process.

Non-US Residents

This Agreement will be governed, interpreted, and executed in accordance with the Bulgarian and EU regulations, renouncing the User’s own jurisdiction and submitting themselves to the jurisdiction and venue of the Sofia and tribunals in Bulgaria, notwithstanding any lawful provision to the contrary.

By using the Services from different locations, Users assume such use under their responsibility and at their own risk. Users must comply with the regulations established in the places where they are located and from where they access the Services as applicable.

Depending on your country of residence, under certain circumstances you may be able to bring a dispute before the appropriate authorities or courts in the country in which you reside.
